Sunday night I received an email from a woman claiming my mermaid name "Nerine the Arctic Mermaid" infringed upon her company name trademark "Arctic Mermaid"

Needless to say this was very frightening and stressful. I was up until 4am trying to research trademark laws.

I did find this out. USA Trademarks are service/product Specific. In her case the selling of stock photography. She claimed it encompassed all things but that is not true.

Also... According to what I read.. Inactivity or dormant trademarks are Nullified after 3yrs. Trademarks not being used currently still have to file certain paperworks.

I potlierly informed the woman that I was not a business but a fictional character. Her reply was less so especially since I addressed her with the southern and respectful title of madam...

The second email also threatened me with more legalities and that she would be billing me for her lawyer at $250/hr for further correspondences.

I have not replied to her last email.

A local artist friend of mines husband, who is very legal savvy did some digging and discovered that her business was involuntarily dissolved and that her trademark is expired according to the Alaskan Business Bureau which is where she is based.

I also spoke to a local trademark lawyer myself. He also agreed this woman didn't have a leg to stand on.

So far as I can tell.. She hasn't tried going after the other mermaid that uses "Arctic Mermaid" in her name.. Lanai is friends with her and passed on the info.

I'm putting this out there. I dont want anyone else to go through that kind of stress. THis could very well be a scam artist looking for an easy target... but in my case its like getting blood from a stone!

Either way. Be ware of emails like this.

When I can afford it. I will be looking into a C&D letter.

Sounds like that woman had a case of the Mondays. If the company is dissolved (I'm guessing that means liquidated) then she could just be lashing out in pure spite of it all. I wouldn't worry too much about her. People like that are full of hot air.

Company is dissolved since 2011.. I've been using name since March 1,2011 officially. There is another compost that is existing called arctic mermaid mosaics.. I wonder if she went after them...

She has the burden of proof and would have to come here to Georgia from Alaska... so yeah..

Well it took the collective power of my friends in the dragon*con fb group and one very internet/legal savvy Artist friends husband to track down all the info. Makes me glad for the solidarity of groups like that. I would have come here for help..but at the time I was serving my banned time. :)

Im only posting about it here so that someone knows its happened before and knows what to do. Its scary having someone come at you with legal stuff like that.. But I found that an email carries no wieght in court. They would have had to send an official letter written by a lawyer to my physical address ..which she doesnt have....

But In the end her claim has no merit as I am not advertising as a photographer under my mermaid name.

All my artwork and photography I do sell is sold under my legal name or Legendary art as in my etsy shop.

Nope. Unfortunately, no judge will grant a TRO without a physical threat, or you have evidence that she's sitting outside your house. It's not easy, and if you do get one, they are virtually impossible to enforce. You're basically asking the court to make it illegal to surf the internet.

Just ignore her, block her, warn others....responding to stalkers makes them worse. Which is what she's being. She's a stalker.

I haven't responded to her yet.. not since the first email.. that's when she threatened lawyers fees on me. That was Sunday night.. now Wednesday she apparently found my linkedin account... I git email notification today.

It took me months for my stalker to give up. Just be aware, some take longer. You might have to stick it out for a while. Just. Don't. Reply. And sadly, even if she does threaten you, police MIGHT not always do anything. My stalker threatened to kill my friend, do...unsavory..things to my sister and I, and we had it all saved and documented, and the police here did nothing. Ignoring is your best best at this point, though. Nothing else you can really do, unless you want to risk contacting her to tell her that what she's doing is cyber harassment and cyberstalking, and it is in fact, ILLEGAL. >,O EIther way, I wish you luck.

Nerine that sounds scary! I have never had a stalker but have had some weirdos to deal with. I think I agree with Mermaid Pickles and try and ignore, maybe engaging will only make it worse, like she wants to see you scared and upset. Dont give her that power. She seems like a sociapath. Just when I thought I was done being bothered by that lady... got another threatening email.. now she is saying I am harassing her... I've replied back to her emails one time and since have ignored her ... I made apsa video on my YouTube explaining the situation... which she reported for first trademark infringement..the privacy.. which were both cleared of.... by YouTube... then I got the third email.. which was loooooong abs very threatening.. ugh... been advised to continue to ignore her... so stressed!!!

I would very much like to see the email. Just stay strong and keep ignoring her threats! (have you ever thought of trademarking your name anyway? It'd almost be funny to do that just so if she keeps attacking you like this you can say you got the name trademarked, so there's nothing more she can do) Lets just hope she isn't psycho enough to try hunting you down in person :saynothing:
