So, a few days ago I saw Lovely Lorelei on Instagram post about how a video had been stolen from her YouTube channel and uploaded on another channel (link: https://www.youtube.com/user/xvostrusalki/videos). I went and checked the channel, and lo and behold, they had stolen my video too. They had stolen tons of videos from other mermaids!!
I detest the type of people that do this. So naturally, I filed my DMCA with YouTube. I also contacted Mermaid Crystal, another mermaid who had their video stolen, so she could file a DMCA as well. A lot of the other videos, I did not recognize the mermaids, or I did but did not know who took the video (like MerMania/MerFest videos). From the free YouTube music she had on the videos, it also seemed like she may have been monetizing her videos as well.

I click on her website (http://xvostrusalki.ru/), and see that her website has TONS of stolen photos from all kinds of tail makers and mermaids!! Same with her social media!

Meanwhile, she emails me and tries to play the sympathy card and asks me to withdraw my copyright claim. I detest these kinds of people, so I didn't hold back in my reply.

Yeah, she actually tried to say that she "accidentally" stole from me. Right. And also that I'm lying about her stealing photos for her website. And she said that she only took 2 videos to show silicone tails.. except there were 3 that I filed against her, and more that I saw on her channel. After those 3 lies, along with the fact that she said if her youtube got terminated she's lose earnings, I think that she's also lying about monetizing the videos.

So I drafted the email I'd send to Finfolk, Mertailor, and Mahina Merfins. And also one to Delphina and Mermaid Magictail, to check to see if she is actually an approved distributor, and waited.

So today, I woke up and she has filed a false copyright claim on one of my YouTube videos, using an alternate email address! It was of the video of me and mermaid bjossa making faces underwater in a pool in Vancouver. Which was shot by me, with my gopro camera- it didn't even have any music, just the original audio- so the content is legally 100% mine.

She didn't even have a source for her claim. She just put in the title which translates to "Swimming in the tails" (so it's not easily searchable I'm guessing) for this non-existent video that "isn't on YouTube".
Not only that, but she used a fake name to make the claim! The name "Александр Кузнецов" is "Aleksandr Kuznetsov" who is a Russian football player!!

I filed a counter notification. Hopefully YouTube sees that this is complete bogus.


Meanwhile, she's taken down all of her videos on her YouTube that aren't hers. At least the ones that could be easily identified as belonging to someone else. But her website remains unchanged. She also started another YouTube channel (https://www.youtube.com/channel/UCEtjzxgqk9rZeDeQ1bfq6gA), becuase if the claim from Mermaid Crystal goes through her channel will be terminated.


I will not stand for this BS. Even though my husband just yelled at me for, "helping people I don't even know and not even getting paid for it". You all are my community. We watch out for and help our own.

I forgot it originally, I put in the post in the first paragraph. But as I said later, she seems to have removed all the content she stole. Actually according to the videos she embedded on her website, she made them private. Probably becuase I told her someone else was going to report her, and she knows the 3rd copyright strike will terminate her account.

Google chrome automatically translates pages, I've been using that. Also if you google the url there's a "translate this page" link beside the url in the search results.

She claims to be selling them. She claims to be an "offical reseller" of Delphina and Mermaid Magictail. And thus claims they have a partnership, and that they have permission to use all of their content (photos, videos, press releases, ect). I have sent an email to both of them asking if that claim is legitimate. We shall see.

And yeah, she put horrid straps on the Mahina. While not illegal, it's really dumb IMO :rolleyes:

What an absolute bitch! The YouTube system really is a flawed one at the moment and they really need to pick up their game in regards to copyright claims. Even some major youtubers are having trouble. The issue is that there are no actual humans checking anything and there are no consequences for false claims.

Thank you everyone so much for your support! I'm filing a counter-notice through email, some person must have to read those and input them into the system right? And since there's not text box limit in an email, I'm using it to tell them what's going on. Also letting them know I can provide as much proof as they need that the videos are mine, and that I'm the one in the videos. I'll even scan my friggin drivers license if it will get my account and videos restored.

I am shaking with rage but also just want to cry. Parts of me are telling me to write her an email and rip her a new one, or ask the community to flag all her shit, or call her actual phone number and tell her to go f*ck herself. Sadly, no. Nothing from email, and I slept right through the help line hours -_- I was so stressed last night I had a big pain flare and couldn't get to sleep for a while. So I slept through my alarms till my husband got home a few minutes ago X_x

But the good news is that I have a really strong case, I went onto my external hard drive archives and found the raw footage for the videos. I didn't even know I still had those! Also scanned my drivers license and got proof of address change (I moved since my license was issued, and they do address changes digitally instead of on the physical card). Just gonna take a photo of me with a sign that says my youtube username, and license, with my tails behind me. Will be sending all of that together to YouTube. Should be more than proof enough!

I also did some scouring and found some alternate email addresses that apparently go to REAL PEOPLE at help desk departments. Apparently this is a, sadly, common form of cyberbullying- and a lot of people have had to deal with their channels getting terminated by people who are spiteful and working on getting them restored and made videos to help others.

Thank you :) If you could do that, that would be great. I've had a response from Delphina and let them know about the situation. But there is a slight language barrier thing going on. So an email from you would probably be more clear than an email from me!

Sad thing is, if this person would have done as I had asked in my first email to her- take down the stolen content she had on her YT, social media, and website- then I would have offered to list her on MerNetwork and help promote her. So she wouldn't have to resort to using stolen media to get attention. But instead she's just being spiteful and making a very bad name for herself.


By the way, on her new channel, two of her videos have stolen video from me in them. And she did NOT remove the Mertailor and Finfolk listings from her site, turns out she just took them off the front page. They're still under the silicone tails section -_-

They didn't let her make another account. Any user who is banned is not allowed to make another. She used a different email address and used that to make a new account. People do it all the time :/

So I haven't been updating here becuase this Tatiana person's associate registered on the forum (and sent me a PM pretending to be someone else), so she apparently found this forum and is reading the thread here. I've posted a lot more details on the situation on my mer facebook profile.

Her and her associate said that if I withdraw my claim and asked Lorelei and Crystal to do the same, then she would retract the false claims made on my channel. I honestly thought about it, because I'm trying to take the high road. (I even contacted her asking to remove the content she used in her videos on her new channel, instead of reporting them first.) But then I realized that she's essentially holding my channel hostage to bully me into doing what she wants. And that is harassment and cyberbullying, not to mention illegal. A lot of people have reminded me I can't let her bully me, and they're right.

So calling YouTube wasn't of much help. They told me to collect all my proof (which is a ton) in an email, and email every YouTube and Google support email and see who responds. She also recommended mailing it and faxing it. I have printed it out and mailed it, just looking for a place where I can fax it and I'll do that. So if I do all that, someone will eventually actually read it, rather than the automated system just dealing with everything.

Good news is that people are offering legal help, which is nice to have if this escalates. I have access to JAG since my husband is military, but they may not be enthused about taking on a case like this if it comes down to taking legal action. So knowing I have options is a relief. I'd rather not have to take it that far, but it's good to know the help is there :)

Thanks Merlissa :) I think both of us are starting to calm down and realize that this is not worth the stress. At least I hope we both are. I will admit right now that I got really angry and reported the content she took from me without asking her to take it down first. Maybe that wasn't the best course of action. I am just SO USE TO people saying that they won't that I've learned to just report it first. Maybe I need to rethink that.

And just to be clear, I don't want anyone flagging/reporting any of her social media pages for fraud or harassment or anything. I know you all are upset for me, and for people she stole content from- and that's really sweet and completely understandable! But I have verified that she at least is a legit distributor for Delphina, and most likely she is with Magictail too. (When I get an update on that, I'll let you know.) She has removed the listings for the silicone tails on her website. So as it stands right now, she is not a scammer. People on this forum have actually bought Delphina and Magictails from her and received their products! (I looked into it.)

If you have content that she took and used without your permission, then do take action. I would recommend either asking her to remove the content first, or email a cease and desist letter if you feel that would work better. (There are templates on the internet if you need them.) If that does not work, file DMCAs- that is your right and you should protect your content and your image. But don't flag things on her social media just to "get back" at her. We do not have to be an angry mob that harasses someone, as tempting as it can be to use those tools to try and defend our own.

I thought she might have taken some videos of kids swimming in tails from other people, But I don't know any of the kids or anything since most people active in the community are older teens and adults.

Looks like Mary's channel and twitter aren't active anymore. I know why it has so many views though, it's on the Mermaid Magictail website (http://www.magictail.de/index.php?option=com_content&view=category&layout=blog&id=24&Itemid=91&lang=en&limitstart=12). Which also is probably why Tatiana used it. If she was given permission to use Magictail's content for promotion, she probably thought all the videos on their website belonged to them. But when you look at it you see that's not the case, that they embed videos from YouTube from their respective channels.

So this week I processed this whole ordeal and had a lot of thoughts. First I felt anger of course, and was concentrating on getting everything resolved through YouTube. And also, if she refused to remove the other content she had taken, to alert those people to the situation. Then I thought, what if she keeps harassing me online? What if this doesn't end? Then I admit there was a little bit of fear, since she has my physical address, legal name, and phone number (thanks to the DMCA laws and YouTube counter claims process).. plus people were saying she could send me anthrax or something, and my anxiety loved latching onto that idea. Then I thought no, I can't give into fear or bullying, I have to stand up for myself and my community. I admit, even though I'm not proud of it, that there was also a little thirst for revenge for what she had done, that she needed to be punished for her terrible behavior and actions. But I was still so angry about it all. Just constantly angry about all of it.

But then, I saw this collage I had made for a class I'm in. It was just a fun little project- we were supposed to make a collage about what we felt we most needed in our lives. Due to all the issues I face with my chronic health and pain issues, I chose inner peace. So I looked at it, and I thought about this situation in regards to that. I decided to make a list of things that bring me inner peace. Ya know, showing affection to and caring for those I love and care about, sitting near or swimming in the ocean, kitty cuddles, creating, all that kind of stuff... and a few of those things I realized that can relate to this situation, is forgiveness (of myself and others), letting go of negative emotions and situations, and helping people. All those other emotions of anger, loathing, fear, want for revenge, ect, just kind of melted away and I finally got some clarity.

So a few days ago, I decided on a plan. I decided to wait until my channel is reinstated through YouTube (not by taking her deal, I was not going to give into her bullying, I wanted it restored the right way), and then I would offer to remove my strike from her old channel. But only if she promises to delete the video immediately once she has her channel back.
After all, this person is just trying to make a living. She was obviously unaware, like so SO many others (seriously, like millions of other people), that the internet is not a place you can just pluck content out of to use for yourself. I think she is learning that lesson now.

She did take down the two videos on her new channel that had my content in them when I asked her to, even though both of them only had a few seconds of my content (and they weren't new, they were reuploads from her other channel). Which was a show of good faith on her part. She also said if I had come to her about the first video and asked her first, then she would have removed it, and we could have avoided all of this. I'm not sure if that's true, judging by her aggressive behavior, but I'll never know what could have been either way.


So that is what I would like to do, now that I do have my channel back. She doesn't have the greatest track record, so I did check on the Google support forums to make sure if she did not take my video down after I retracted the claim, that I could make a claim again on the same video. (They said yes I should be able to do that.) Hopefully that will not be necessary.

I may offer to help her by identifying all the content that she doesn't own, so she can either take it down, or ask permission to use it (and give credit where credit is due). After all, my whole goal from the beginning (from the very first email I sent her) was to put her on the road to having a successful business the honest way. Just turn this whole thing around- from anger, into helping her business succeed the right way.



I know some of you (or a lot of you) may not agree with me on this. But seeking "revenge" and fueling anger doesn't feel good ya know? It can feel "right" or "satisfying" and justified in the moment, but in the end, those kind of feelings just fester and eat away at you. Even if she did get what was coming to her (with her channel being removed). So I'm going to give her one last chance. If she blows that chance then I'm done. But this feels like the right thing to do, and I hope you can understand that :)

I had already filed a withdraw of my claim (and told her as much and sent her screen shots to prove it) but she said she filed a counter claim to "accelerate" the process- even though they are two separate processes all together and it would not do that at all. So now I would not be able to file another claim on the same video (I would have been able to if the withdraw of my claim went through first- if she didn't follow through with her promise to remove the video after the claim was withdrwn). She's claiming fair use for "educational purposes" which is total bullshit. That sneaky bitch.
The only way to keep the videos from going up now is to provide proof to YouTube that each of us is filing a law suit against her. Otherwise, the videos will go back up in 10-14 business days.

I tried to be nice. Shows where it got me. I really hate people sometimes.

The other strikes have been resolved, so my account is back in good standing- yay!

Tatiana's old channel is back up, and she has indeed removed my content from her videos (I believe there were 3 in total). 2 of them using the trim tool that YouTube's enhancement editor provides. The video I filed the complaint about was deleted by her. So she did follow through with her promise, instead of using the counter claim to keep it up. So that's good news!

I know I was really angry in my last post, I was angry for Mermaid Lorelei and Mermaid Crystal. Also I was especially really really angry in general about how easily the system can be abused. Not just in this instance, but in so so SO many others all over YouTube. In my research about the system I learned a lot about it. It just made me very angry for both legit fair use being targeted by big corporations, and also by instances like this where it can be abused and used as harassment, or doxxing, or stalking, or a number of other things. So many stories with unjust endings due to the broken system. So yeah, when I saw that email all that anger just kind of made me pop.

But after seeing Tatiana follow through with her promise, I still have a small amount of hope that when Tatiana's counter claim on Lorelei's and Crystal's videos expires, and they are put back up (and the strikes removed from her account), she may delete them. But I don't know... unlike mine, I believe both of the videos were entirely comprised of their content. Mine was just bits and pieces put into other videos that could be trimmed out. (Well, besides 3 of my videos that were put together into one and put on her Facebook page, but that was removed.)

I guess we will just have to wait and see what happens.
