View Full Version : Swimtails Fraud? Paid for a top and it never came

Hey everyone, I've gone off mernetwork for a while to focus on school, but I decided to come back to ask/warn about my experience.
I've been having some real trouble with swimtails lately. So I ordered a fusion betta tail in june of this summer and it arrived in less than a month. It's so beautiful and swimtails does such a good job with them. In love, I decided to treat myself to a matching top from their new line as a back to school gift. It was somewhere around $80, for a top! On the description it tells me that it would take a while to get here, withing 2-4 weeks. Well, it has been 2 months, and nothing has turned up in my box.
Like I said I'm a loyal customer. I didn't want to jump to conclusions because they were so good the first time, so I sent them an email to see where my top was. All it said in the order status was "processing", so it wasn't lost in the mail. I got an automatic response a few hours later saying they'd put me in contact with a representative in the next day or so. That was 2 weeks ago. I tried calling their number just now and yep, you guessed it, nobody picked up the phone. I don't understand what is going on, because this is how scammer tailmakers would behave. They took my money and disappeared.
Has anyone else been experiencing this?? I don't know what to do..

I purchases a skeleton tail in early October. After contacting them on FB around 10/27, they responded asking for my order #. I have messaged several times and have gotten no response. I also emailed. I went back into my Paypal, and noticed that the payment went to a "Ryan Newman" and was actually a completely different website, even though the item listed I bought was a tail. When I go to swimtails now, I cannot find an option for Paypal. Anyone have this problem? I am thinking maybe the site was hacked at one point and orders a payments went to someone else?

They've confirmed that their Instagram was hacked, but I don't think that would extend to the regular site. Maybe if you reach out through social media you might get someone else?

Their instagram was used by an employee to tell some hard truths before they left. Luckily that means they probably aren't shutting down?

I have messaged on FB, Instagram, posted on their FB posts, emailed, and messaged on Paypal with no response. Awful customer service right now. I filed my dispute via Paypal.

So here's my take on it, keep in mind this is my EDUCATED GUESS and shouldn't be used as a formal statement on what's happening.
I 100% believe it was the wife who made the posts. The co-owner of the business. There have been multiple complaints about how her husband handles business and social media on FB and I think a few posts somewhere here too, and on instagram. One of the now deleted posts said something like "how could he do this to me, this business was my baby" that is not the type of thing a random hacker does (random hackers don't make stories, come on now folks) and I really don't believe a rando employee got access to their instagram either. Nor that they'd go through such an elaborate thing.
I think the "hacking" was the husband regaining control of the account, locking his wife out, and trying to do damage control. I do believe he probably cheated on his wife, I have sadly seen this go down a few times in the mer industry :( husband/wife partners that own businesses. Anyone remember... Mermagica?
I personally messaged the wife and said I was really sorry to see the posts and I sent her some encouraging messages. The discounts and liquidation of items is still up, and orders are still back ordered.
So regardless of their personal situation (sorry I do not believe for a second it's a *hacking*) the current company state is not good. There are also reports all over the BBB and some google searching is showing up a lot of complaints about undelivered product, and the husband being awful to customers.

Adding my name to the list. Ordered on Oct. 4 when it was saying 4~5 days shipping. When I had no word on the 15th, I messaged over FB and was told there was a delay in getting material. I've heard nothing since. I've tried 3x over facebook, two emails (the first generating an automated reply that a ticket was opened) and a direct phone call that rang until it went back to the start of the phone system.
I'm not very hopeful, but I'll give them until the end of the week before I do a CC charge back.
Sad state all around, I had such a great experience on my first order.

I ordered a blue siren tail on September 19th and was so excited because this will be my first tail and now from watching the Insta post and this forum, am really hoping we all haven't been screwed out of our purchases. I really hope the situation is resolved soon for all of our sakes.

Ok. Not saying Raina is wrong about what happened, because I don't know.
But swimtails specifically has a business model where tails take around 6 weeks to complete. This is because they don't keep actual, ready to ship tails in stock, they keep a screen printed "tail blank" that they cut to size, see, and ship. If you're bigger than a standard size, which I was when I started swimming, this is a huge deal
From what I've seen, they don't do an awesome job of advertising this, but customer service is pretty good about updating you if you email, though they've probably gotten a lot of tickets in the next system from the Instagram hack.
I'll admit, I feel personally invested because I don't feel like I would have kept mermaiding if a mass market plus sized option wasn't available, so I really hope they pull through this.
If it were me, I would check on the deadline to file a charge back. If it was close, and I'd emailed customer service with no response, I would initiate the charge back, because that's the best way to protect yourself. But if you have time, I think they're worth giving what time you have.

Your order has been received and is now being processed. Please allow up to 5-14 Business Days before your product ships. (Not Including Weekends) All Mermaid Tails are made to order here in Colorado, USA.
I asked on Facebook on Oct. 15, 2018 asking for an update;
Alrighty. We are still trucking away on your order of the electric dream tail. We are having some more delays with receiving fabric, so it is going to take a little bit longer than normal to get this made and sent.
OK, fine I thought. I left it alone. On Oct. 18th, I got a second email about 10% off orders, and asked if my existing order could receive the discount. I got no reply, so I just assumed that was their "no".
On Oct. 25, I again asked for an update on my order. At that point, it had well exceeded the initial "14 days, not counting weekends". As before, no response at all.
On Oct. 31, I sent an email via their support system asking for an update and I got this automated reply;
We would like to acknowledge that we have received your request and a ticket has been created.
A support representative will be reviewing your request and will send you a personal response.(usually within 24 hours).
I followed up again on FB yesterday, and still no response. I also replied to the automated message, and heard nothing in return.
Either they are incapable or unwilling to respond to customers. If there is a legit reason for delays, fine, tell us. Being completely stone-walled is not acceptable.
I've decided that if I have not heard something reasonable by Friday, I will proceed with a credit card charge back (and I've indicated I would do this in a final email I sent yesterday).
I don't know what the real story is, but I am also starting not to care, either. I have empathy if there are personal issues... If there was an affair, then that's terrible and I genuinely feel bad for her. These feelings though are, by necessity, separate from business. If they had any concern for customers or the long-term viability of their business, they have to communicate (directly or publicly) to customers. They need to indicate when customers can either expect product or refunds. We trusted them with our money.
And for reference; I am a business owner and I had to keep my business going during and through the break-up of my marriage. It sucks, badly, but that's part of the job when you go into business. You can't just walk away and expect everything to be OK when you decide you're ready to return.

Hello Madison, we apologize about the delay, we will begin shipping late next week and it looks like your order is on priority and will be shipped as such, one it does you will receive email notification
I'm cautiously optimistic. I had asked to cancel my order and, barring a reply, would request a charge-back. Given they did reply before Friday (if just), I've decided to wait another week. If they actually ship, excellent. I genuine hope they're getting back on their feet.
If I don't get a shipping confirmation by the end of next week, then I'll have to assume this is a stalling tactic. I genuinely hope that's not the case. They do make a great tail... Fingers crossed.

I really hope they figure this out. I don't think I would have started mermaiding if I hadn't found a tail that would fit me when I started.

This is so sad, now I understand why I haven't received any responses to my queries about their siren tails [emoji853] Some of us can relate and those posts seem to have been made by someone who is distraught and emotionally shattered. It's the worst way to have your heart broken.

I would not order anything from Swimtails right now. If they start shipping back orders, and people start reporting that they've received their orders, then I might consider it. I would wait until the new year and see what people are saying.

Uptdate: my top still hasn't come. I'll unhappily wait since vermont winters are long... but I've basically all but forgotten about my top and have given up hope it will ever come. The wait was updated to 6 weeks for tails but come on.. one measly little top takes 3 hours to cut and sew.
It irritates me that they're putting out new products still like all the Halloween special tails. They advertised it a lot in their instagram stories so it would appear that their company is still pumping things out but obviously they're not. I don't know I find it weird... like they usually make posts with happy customers in tails but I haven't seen a single new tail featured since this all began. They're trying to expand their business but not delivering?
The little sympathy I had because of the affair is evaporating... They probably know that most potential customers that are on mernetwork won't buy from them now so they were pretending they could get you a Halloween themed tail within October. Makes me laugh...

I'm six weeks in on an order that said 5~14 days. My patience in thin, but I'm giving them a little bit longer. If it's clear I won't have the tail in time for the holidays (early dec. for me), I'll give up waiting, too. I have empathy for a breaking up marriage, but that only goes so far in business.
This said, I do genuinely hope they turn things around. There's no question that their stuff is good.

I really wish they would make an announcement or something saying orders have stopped until further notice and that all current orders are being served in the order received. Like, don't let other people keep ordering and get their hopes up and let them get dragged into this hellish mess. And then with more and people getting dragged into this mess, more and more complaints will come in saying how swimtails is bad at business then they'll really be in trouble. Isolate and control the fire that is already burning and keep it from spreading.
...but that's just me.
I know it must be a pain for the poor woman to deal with too, trying to sort this mess out. Still holding on to hope and checking on this thread daily. Keep holding in there everyone!

I just called the bank and they said they cant force a refund on anything past a month (or was it 60 days?)... Either way, swimtails is asking you to wait until the golden hour for returns has passed before starting to get worried about whether its late or not. Dont let this happen to you!! Get a refund before its too late!

A lot of us have all but certainly lost money. This excuse about fabric is not true. If it was, they wouldn't have gone totally radio silent for so long.
Until and unless you start heading about lots of people getting tails, sending them money is a fool's errand.

Yeah don't buy here! I've been waiting for an email, pm, etc for 2 months since the last "fabric delay" message and nothing. Their phone doesn't let you leave messages but hangs up on you when the beep should kick in for the recruiting!
Im devastated. This killed my desire to mermaid. It may not mean a lot to some people but this tail was to be the culmination of my overcoming my chronic pain and illness to embrace life and accept i can still be happy. And now this tail represents nothing but betrayal failure and the shitty nature of the human race.
I had a really awesome friend donate most of the money so i could get this tail in the first place so its not just my disappointment alone either. Family and friends keep asking when its coming bc they knew how excited i was.
Back to wishing i could do anything fun with my pathetic body. #feelingheartbreak

I was told 16 days ago that shipments would start in a week, and that I was on the priority queue. I've tried twice to get an update, and I've heard back nothing.
This isn't a fabric issue... They owe us straight answers. As more and more customers run over their limit for a charge-back, they're going to find themselves not just facing upset customers, but customers making actual fraud charges.
The good will they've earned in the community has given them a lot more slack that most companies would have gotten, but even that is running out.

It is so heartbreaking to hear that this is still going on. Swimtails was the one place I was saving up to buy a fabric tail from but my own disappointment is nothing compared to those of you who paid only to be ignored :(

If you are still in the window to charge back on your credit card, you should do that. It's not easy to get your money back with a lawsuit.

For anyone who didn't know, swimtails has started processing refunds and teamed up with mertailor to offer discounts for his tails if people still really want to buy a tail. I know this whole thing has been a huge mess for both swimtails and anyone waiting in limbo over a tail. I've seen MANY companies go under in my decade here and while I know people are angry, there does seem to be a real effort to do what's right even though it's taking a long time. I've seen similar companies like fishbutts and mermagica just disappear without a trace, and people's money. So I'm glad to see swimtails is trying even though it's taking a while. Figured people could use this update, it was shared by a mermaid getting a refund, and I thought Eric's reply was really classy and worth a read too.

If theyre going out of business how come theyre like posting new things on their website and stuff seems kind of confusing or they actually filling any orders or they just scamming you poor souls out of your money from way back in spring/summer?

nope, people are still trying to get refunds (and a LOT of the refunds are being canceled because the source bank account has insufficient funds

I don't think 'swindled' is the right word though, there has to be an intent to cheat customers which probably doesn't apply here.
That said, they can't pay back or fill orders. Let's hope something changes for the better soon!

I am sceptical. I would love to hear that they have returned to form, but I won't be risking my money for a while.
Had there been any actual word on what happened? On why they kept blaming things on fabric when it was clearly something much more? What has been done to ensure customers won't be left for months with their money tied up?

I am shocked they're doing kids tails. Mahina had to go on a big thing due to some liability issues to get tail makers to stop making kids tails using her monofins. I wonder what changed.

Nothing's changed on Mahina's side. From what I read on her website, she'll never offer full tails with her monofins to children. The most "tail" they'll get, is leggings, so kids can kick out their feet and swim naturally to safety.

I'm still waiting on my refund. Ryan told me that they would "reprocess the refunds" to those who hadn't got them yet and we should get them by the 4th of Jan. That didn't happen but he won't do anything more until 10 business days is up :(

I'm back in the waiting game... My bank got to me after weve waiting for our money back and said there is nothing they can do on their end and it is Swimtails responsibility to refund the money. (at least my bank tried)
As of 8 hours ago Swimtails issued an apology letter via Instagram. I messaged a couple other mers on Insta just to keep in contact with each other. I'm back in the waiting game... My bank got to me after weve waiting for our money back and said there is nothing they can do on their end and it is Swimtails responsibility to refund the money. (at least my bank tried)
As of 8 hours ago Swimtails issued an apology letter via Instagram. I messaged a couple other mers on Insta just to keep in contact with each other. Yeah I commented about how we will forgive them when we have all seen our tails/refunds and they messaged me saying all refunds have been paid out and everyone is happy

Yeah... I had my bank go through my records and they found no history of any refund transaction from Swimtails. They'll be getting yet another email from me.
Like why would they not have records of who've they have and have not refunded? Maybe I'm just being paranoid but there's so many fishy details to this fiasco.

I was a little happy when I saw they were active again, but I'm staying well away from them if people still don't have their money or tails.

My husband and I bought the Sea Serpent Pro and the Sunrise Pro (with a top for me) mid last year when the Australian Government was changing taxes (for the worse) on items entering Australia. I asked them to expedite the shipping and production to avoid the increased fees coming in at the end of the financial year. They did a great job and were very responsive all the way through the process so I was very shocked at all of this kerfuffle.
We love our Pros. The Mahinas were were able to get locally so that might have been a help shipping wise. Such a difference powerwise to the2tails!

Yes I've heard they are doing orders again. Last time I heard someome just had it shipped so we shall hear soon I guess.
Also I got my refund back from my bank. Not Swimtails. I don't care if they are doing orders again and if they get a rep back. No way am I ordering from them. I'm too traumatised.

My Swimtails story was around a year ago this June, I ordered their electric dream pro tail and after waiting around 4 months and after several back and forth messages they asked if I would rather have one of their already finished Beta tails since mine still hadn't gotten finished. I was rather excited by this offer due to the price difference of around $150 dollars. So I excepted and it was shipped and received that month. I love the Beta tail, but it's for more slow swimming. I decided to give them another go since they said their company was doing some changes to make itself better, so I ordered their Moon Mermaid tail for the Mahina on Jan. 16th 2019. I just received it today Feb. 11 2019 and it's AMAZING! The colors and fabric are rich and thick. The only draw back I've found is it's rather difficult getting the Mahina in, so be careful and gentle. Haven't swam in it yet but already making plans. So it took about a month, but that's way better than 4. Hopefully this means Swimtails has a brighter future in the mercommunity. They do seem to have a better system and are coming out with so many beautiful designs like the Whale Shark and Mackerel.

Same here. They have a lot of lake/darker designs that are very appealing and rare in a world of tropical/bright mers. If they accepted paypal I would be a looot more comfortable ordering sooner rather than later.

Im still waiting for my refund *sigh* when I talked to my bank they said they couldnt reverse the payment on their end, have other people managed this because I might try again and push a bit harder, I dont see me getting it from Swimtails..
To be fair to Swimtails it seems like it might be their merchant processor Stripe that is causing the trouble with the refunds, Ryan copied me into correspondence with them trying to sort it out and they made this ridiculous excuse that it had actually been done as a reversal and no money had changed hands because the refund happened so soon after the payment. Which is so obviously not true because I paid for the order in September and they didnt start refunding people until December! And the money is clearly gone from my account! I was pretty shocked that they would try to say that..
So yea I wouldnt recommend giving them your money unless you have a way of getting it back like PayPal..

It depends on when my fiance gets his new job. He took a few months off to clear his head but he's getting callbacks already ^_^ hes cherry picking the best ones so it will take a few weeks i imagine.
After that we will be scheduling it out. We were hoping late march/april around my bday ^_^

So update on the whole Swimtails front. I'm not sure just how new of a development this is but it looks like their website has undergone a pretty impressive overhaul; especially on the mobile front. It also appears that they're taking paypal again! Maybe they really are trying to fix things now.

The issue i always see in situations like this is that the rare good experiences are a must to keep the fraud going. Nobody purposely buys from a company NOBODY gets things from. The good reviews if legit are the way they get people to give them benefit of the doubt, like i did!

also, for real, the BBB is actually completely useless. y'all remember yelp right? where you rate restaurants and stuff? that's all the BBB is. it's basically just an older version of yelp. they have no standing, in anything. complaining to the BBB about a business? great! nothing will happen. nothing ever does, because it's not a government entity. a business with a good BBB rank means nothing in the "real world" it just means people like them.
most businesses have figured this out and do not care if you call/email the BBB about them, because it doesn't affect anything. the only things that can affect businesses are the actual government sanctioned entities like health inspectors, OSHA, etc. if you are absolutely insistent, call the IRS since they handle fraud.
