Mermagica.com (Jose Daliva) - "F" Rating with the BBB

Several friends and I have attempted to make a purchase from Mermagica.com. All I can say is that they are a total rip off and I can not recommend that anyone purchase from them. I have files a complaint with the BBB in Dallas, TX. They said they have received over 48 complaints so far in 2012 and that they are working the case. I have also notified the USPS and forwarded several tracking numbers that Mermagica provided to us as valid. Since the dollar amount of our cases against Mermagic we are asking that if you have been frauded or feel you have been frauded from Mermagica.com or the Daliva Family. Please provide your contact info so we can discuss to see if we can arrange proper compensation.

We have compiled some info on Mermagica and are in contact with several past employees and they are willing to work with us on this.

I've heard about the scams, it's terrible. But did you name yourself MaMagica specifically for this thread?

I think a few people have joined specifically for this. It's weird, I only hear about this stuff exactly around con time. it happened last year at mer-con, and this year at merpalooza. The only complaint I hear is that the tails come late, which seems to be an issue of back ordering monofins. Not cool. but as far as I know people always get their tails eventually, they fit, and have no further complaints. Im not defending them at all, they should change the wait times on their website or stop taking on orders if they've run out of materials.... but as far as I have read everyone always gets their tails eventually unless they cancel their order.

I wish people would contact the BBB about other tail makers...

Well this is what I think. I don't care what you charge or what product you are to deliver. If you can't then say you can't. Don't take someones money and put them off till you are ready to produce and ship. When I checked into who owns the business and found all the details I was appaulled to say the least. I live within 60 milesof them and all of us whom ordered from them was going to pay the Davila Family a friendly visit. If they want to play games we sure can too :)

Yes MaMagica is awesome! I am thinking about starting a business, collecting the money and sending the items (if I feel like it) when I feel like it.
Hell it works for Mermagica it can work for anyone!

There are places on ebay that do the same thing. I ordered a monofin the little mermaid shaped one for my daughter. I paid the buy it now price, and waited. Two weeks later I asked why they hadn't shipped it yet and after 3 emails they finally replied saying that they were not getting a shipment in for another 2 months and would ship it out when they got it. I cancelled the transaction and got my money 24 hours later. I am glad I did the transaction through a source that I could dispute the transaction in.

not a good idea to openly post threats or plans of how you're going to cause problems for someone on the internet. Just a tip. I get that this upsets you, posting about it will help you deal, hopefully find a solution, and put pressure on mermagica to shape up or ship out (literally) but I had a tail maker do exactly what you're doing to ME because I posted a negative review about him, and I got the police involved. Dont think because you're online you cant be held accountable and people cant find out who you are. If the mermagica people wanted to, they could easily prove you're planning to harm them from posts like that, and then where would you be?

So yeah, vent away, ask for advice, look for solution, put a little pressure on... but threats are threats and not allowed on the forum. I dont want you to think I am against you- you have every right to be upset about this situation, but if we allow you to do certain things then it gives permission for more dangerous people to slip in and do it too. People who might not just be "venting".

Didn't see where there was a threat anywhere in this thread :no-no: and I am not causing problems for anyone on the Internet. I have the right to voice myself and make statements as they pertain to facts in this matter. The performance or lack of performance of Mermagica, Mermagica.com and the Davila Family/owners. These are facts that I have confirmed. If you go to the BBB site and put in Mermagica what do you get? You will receive a company whom performs poorly for the past 18 months and has an F-Rating with the BBB. This is a fact. Another fact that is that is company is owned and operated by the Davila Family. Jose Davila was the registra of Mermagica.com in 2008 and it does expire this year. Do I personal know Jose or Carey, no I do not nor do I wish to. Does the employees know the Davila family - yes they do. I have also took the liberty to confirm that they indeed worked for Mermagica and just wasn't some passer-by saying they was. If you google Mermagica you will notice that there are more less than desirable attributes associated with Mermagica than positive. This is unfortunate but these are the facts. We currently are gathering information concerning these matters so I am only at liberty at dispensing the facts as they are openly found on the Internet. My husband is an Attorney in Texas so he is more aware of the law than myself. I do however appreciate the info and will pass that information along to him so he can better educate myself in these matters

Also I am not here to vent. I am here to inform and educate. Maybe even learn a little about what facinates my daughters about these mythycal creatures called mermaids. I am not really upset about the situation with Mermagica on my own account but I do not wich this to happen to others. I read posts from little girls that have ordered items from Mermagica. Those young ladies likely saved up for their tails and they was obviously upset about the lack of response or aknowledgement of their order. I find that the most appaulling to say the least. For anyone to put one over a young individual is the most disturbing as I see it :mad:

I ultimately was hoping Mermagica would fix their internal issues and chaulk this up to a learning experience. If they don't address and fix the issues at hand well unfortunately evolution will remove them from the pool.

This is a public forum. No one is "butting in", we're all able to post wherever we want in reply to anything. You're being extremely defensive, and when you attack members it doesnt exactly give you credibility with your claims. And to make something clear, if you're here for all the reasons you listed, you need to change your tone, now. This is a FRIENDLY community, RESPECTFUL, and kind. Mermagica does not participate in this forum. Please go write a review in the review section of your experience, that's the appropriate thing to do.

You do not own the forum. You do not own the thread. If you did not want opinions you should go post in your own blog on your own domain where you are an admin. You are not an admin here. In fact, as far as I can see you're someone who joined to warn people about mermagica (your join date, the majority of your posts, and your username says it all) and then got upset when people didn't react the way you wanted to.

I've posted threads. Sometimes I don't get agreement, sometimes I don't get the answer I "want." Sometimes I get frustrated. But I never, ever talk to another member the way you have. I realize I do not own this forum. That's like saying going out into the street and marking off an area and then telling people to stay out of it. It's not yours. If you want something you can control, stay in your own backyard. If you want a free sharing of ideas and information, you are welcome.

My mermagica tail came to me one month late, the wrong colour and with its scales backwards... I wasn't a happy mer at all :/ In the end, I ripped apart the fabric and just took out the monofin to use by itself. I paid $300 for shite.
