Mermaid Photine

I know that some people say that mermaids are mammals because they swim vertically, but what about mammalian mermaids that are disguised as fish? Lots of creatures have markings to look like other ones, like how the hummingbird moth (http://www.symbolicmessengers.com/Wildlife/WTG/Bugs/Hummingbird_moth_C14647.jpg) looks like a giant bee. Could we say that's why fishy mers still swim up and down?
