OkayI'm abit upset. There is a new tail company or and one of their tails lips like they kinda style the design of my tail I made last year. Now I understand if they are just filling an order or if was a coincidence but I still feel like they are Rio ping I'd my tail design a bit. From fluke shape to color it looks a lot like mine. Maybe I'm of base and I shouldn't be feeling this way but I don't know. Let me know your opinions. Cause in fluking out a bit. In any case try not to let it get you down. There's a few well known new tail makers that have been pulling this. I happen to know that one of them got their start by borrowing another tail maker's tail and taking it to a spfx person to dissect it and figure out how to make them -_- . It seems to just be standard now that people rip each other off. Try and use it as fuel to make something even better. I know that's a crappy consolation but professional courtesy and respect doesn't seem to exist very much in this community.

"Professional courtesy and respect" are pretty non existent in any business these days, but if you didn't copyright your design and process, I'm afraid you don't have much of a legal precedent to pursue. It would be a lengthy and expensive process, and, at best, all you might get is acknowledgment that your tail design was their inspiration.

Sadly, just keep swimming is probably all you can do about this design. But if you know a lawyer, you might be able to find more info from them regarding a course of action. Good luck!

you can't copyright tails. Or tail designs. We've investigated this on meryuku (which predates mernetwork) very thoroughly. So there is no legal way to pursue. Mertailor tried and the best he could do was copyright one tail as a sculpture and that was pretty thin legal coverage too.

several of us consulted lawyers and researched the hell out of it so I doubt that. You can't patent a tail. You can't copyright the paint scheme or tail design. Same thing goes with clothing, so the general laws around clothing tend to be the same on tails. With clothes you can copyright the brand logo. But if someone makes a knock off of your design right down to the last detail, as long as they don't label it with your logo they're legally fine. Pro tail makers tried to make those threats before the "I'll sue you" kind, but that is actually illegal too- called "Legal Bullying" and once all that came to light, well people stopped. I think for us long timers this is all history we know but I forget a lot of people weren't active or around to see it. It's like the princess ones. Disney has the characters copywritten, but even that only extends so far. Hence people finding loads of loop holes to be able to portray disney characters for their business without having to pay disney any money or worry about legal repercussions.

there are circumstances though where companies pay you a fee and make you sign an agreement that you wont make a tail like the one you did for them. That's why Thom SHouse can't make "splash" tails and had to do an alternative design. Touch Stone (aka Disney) bought the rights to it.

Many of any copyright laws around costumes that DO exist, exist around specific characters and the copyright is for the characters likeness. So, Mike should be careful about his 13th year tail haha. That being said, I got official approval (as I shared on another post) from the person who designed the splash tail! (he even bought my book!)

I'm not really caring about copyrights and that stuff. Its more the blatant copy as it is nearly identical. The only difference is it isn't my extended tail. The look is the same but you can still see the heels and it isnt 9 ft long like mine.
