Copying flukes is one thing, trying to "trademark" paint options or even scale options, is pushing it. Some people don't want to wait years for a tail just so they can get the paint job they love. If I'm paying $3,000 for a tail, and I want scale tipping, the designer would be shooting themselves in the foot if they don't do it. In the end tail makers need to actually sell tails to make money to live. Scald tipping, stripes, tattoo sides, spots, swirls, etc etc etc, there are only so many interesting ways to do things. The more tails people sell, the more those ways are being used up.
